if there is no hukum in islam regarding any matter, the ruler can use takzir to impose some laws.

in islam, there must be 4 kesaksian(a man is considered one while a woman is half) for the judge to use hudud either stone to death or canning. but if there is only one kesaksian, we can use takzir. if 2 kesaksian, can use takzir.if 3 kesaksian, can use takzir.but if there are 4 kesaksian, then only can enforce stone to death or canning.
